Q: Husband has removed his personal belongings from our houseMy husband and i are having marital discord. he is in a govt job. So we are residing in a govt provided accommodation. Lately, he has removed his personal belongings from our house. He was somehow instigating me everyday that i get frustrated and leave the house. But I did not do that.I wanted to ask that in this way, after 6 months, can he file for divorce, citing that both of us have been residing separately since 6 months?
Advocate Sudershani Ray answered
Dessertion can be a ground for divorce. But the period of seperation needs to be two years atleast. He can file on this ground only when two years or more than two years are completed of living in seperation.
Q: Wife Filed fake case in CAW because I revolted against her 1st marriag
I am posted in Kolkata, used to stay in Delhi with my wife. I came to know about her 1st marriage and divorce hence I revolted. Then our family met and had a big quarrel. She filed fake domestic violence case against me and my family at CAW Cell. Then she also filed a case in Family Court. Its been a month now. Now I received a date from CAW Cell and the court as well. I want to fight the case in the court. Should I also go to CAW Cell or only respond to them that matter is in the court now?
